Judge: Neighbor's NY noise suit against Madonna OK (AP)

NEW YORK – Madonna has lost a bid to get rid of a neighbor's lawsuit claiming the superstar made a racket by using her New York City apartment as a rehearsal studio.

A judge turned down Madonna's request to dismiss the suit. Her publicist and lawyer didn't immediately respond to requests for comment Wednesday, after the Aug. 24 decision was reported in the New York Law Journal.

Karen George says Madonna's dance and exercise routines subjected neighbors to "blaring music, stomping and shaking walls" for up to three hours a day. Madonna took steps to dampen the sound in 2009, but George says they didn't work.

She sued Madonna and the building's co-op board. They say the noise never topped legal levels.

The judge says the dispute warrants a trial.

Militant makes death threat against David Letterman (Reuters)

LOS ANGELES (Reuters) – A Muslim militant has urged American followers to assassinate talk show host David Letterman, saying his tongue deserved to be cut out, a U.S. intelligence monitoring group said on Wednesday.

The SITE intelligence group said the death threat was posted on an online website used by militants after the writer became upset by a joke Letterman made about the death of a leading member of al Qaeda killed in an air strike in Pakistan.

The militant called on Muslims in the United States to "cut the tongue of this lowly Jew and shut it forever," the threat against Letterman said, according to a translation by SITE. The popular late-night television host is not Jewish.

The FBI said it was taking the threat seriously.

The writer was angered by watching Letterman on his show drawing his finger across his neck while talking about the June death of senior al Qaeda figure Ilyas Kashmiri.

The message was posted on the website Shumukh al-Islam. SITE analyst Adam Raisman told Entertainment Weekly the website was "a clearing house for al Qaeda material" and drew supporters of the group headed by the late Osama bin Laden.

Executives at broadcaster CBS and a spokesman for Letterman declined on Wednesday to comment on the threat.

Tim Flannelly, an FBI spokesman in New York, said the agency was looking into the matter.

"The FBI takes all threats seriously and we will run it down like we do all threats," Flannelly said.

A Muslim group in 2010 threatened the makers of "South Park" after the animated satirical show depicted the Prophet Mohammad in a bear suit. Most Muslims consider any depiction of the founder of Islam as offensive.

A 21-year old man from Virginia was sentenced in February to 25 years in prison for publishing the home addresses of the "South Park" creators and urging readers to pay them a visit, as well as trying to help a Somali militant group.

Ethics complaint against Sarah Palin dismissed (AP)

ANCHORAGE, Alaska – Alaska officials have dismissed an ethics complaint filed against former Gov. Sarah Palin that alleged she violated state law because the TLC docu-series "Sarah Palin's Alaska" took advantage of a state film production program she signed into law.

Malia Litman of Dallas filed the complaint. She also alleged Palin benefited from the production of the eight-part series in violation of a two-year moratorium that bars former officials from being compensated for assisting others in dealing with the state.

Film office documents show producers of the reality program received nearly $1.2 million in tax production credits after spending about $3.6 million in the state.

The complaint dismissal says there's no basis for the grievance.

Judge extends order against Halle Berry intruder (Reuters)

LOS ANGELES (Reuters) – A judge on Monday ordered an alleged stalker who was arrested outside Halle Berry's home to stay at least 100 yards away from the Oscar-winning actress and her daughter for the next three years.

Richard Franco, 27, was arrested last month outside the actress' Hollywood Hills' home after he climbed over a security gate.

On July 12, Berry was granted a temporary restraining order against Franco, and the new order issued by Los Angeles Superior Court Judge Carol Boas Goodson extends the original order to August 1, 2014,

Neither Berry or Franco were present during Monday's hearing but in a sworn declaration Berry outlined how Franco had entered her yard on several occasions, and one of which, Franco tried following the actress into her kitchen.

Last month Franco was charged with a criminal count of stalking and one count of first-degree burglary related to his alleged break-in of a guest house on the actress' property.

Berry, 44, became the only black actress to win the Oscar for best actress in 2001 for her role in the movie "Monster's Ball".

Berry granted restraining order against intruder (AP)

LOS ANGELES – A judge has granted Halle Berry a three-year civil restraining order against a man charged with stalking the Oscar-winning actress.

Los Angeles Superior Court Judge Carol Boas Goodson granted Berry the order Monday without requiring the actress to attend a hearing. Berry wrote in a petition last month that she was "extremely frightened" of Richard A. Franco, who was arrested after scaling the wall of her house July 11.

Franco is required to stay 100 yards from the actress and her 3-year-old daughter.

Franco remains jailed after being charged with felony stalking and burglary. He is accused of entering Berry's property three times over a three-day period in July, including an incident in which the actress says he nearly followed her into her home.

Halle Berry wins stay away order against intruder (Reuters)

LOS ANGELES (Reuters) – A judge on Tuesday granted Oscar-winning actress Halle Berry on a stay away order against a man who she said intruded on her Los Angeles property three times in recent days, before police arrested him.

Los Angeles Superior Court Judge Carol Boas Goodson issued a temporary order directing Richard A. Franco, 27, to stay 100 yards from Berry and her young daughter.

Franco, who has a history of violence, theft and drug offenses, was found to have a book with "nonsensical ramblings" and Berry's name in his handwriting, the actress said in court papers posted at TMZ.com.

Franco first approached Berry's home on Saturday, when she was talking to her manager and saw through a glass door that Franco -- whom she does not know -- was in the gated back yard, the papers state. Berry's manager yelled at Franco and he left, she stated.

The actress further said that on Sunday, she went to her kitchen to get a Diet Coke and noticed Franco was on the other side of a glass door, less than a foot away.

"Panicking and in fear of my life, I turned my body and quickly hit the deadbolt lock on the glass door," Berry said in the court papers.

She said she ran upstairs to call police. That evening, arrangements were made to have armed security officers at Berry's home, and as a result on Monday, Franco was caught when he returned.

"This person has invaded and trampled upon the most fundamental sense of security I have and I am extremely frightened of him and what he might do to me or those I love," Berry said in her court papers.

Franco was booked on suspicion of stalking, according to the Los Angeles Police Department.

The Los Angeles County Sheriff's Department said on its website that Franco is being held in jail, and that his bail has been set at $150,000.

Berry, 44, won an Oscar for her role in the 2001 drama "Monster's Ball." She also starred in the movies "X-Men," "X2" and "X-Men: The Last Stand," and in 2008 she was named Esquire Magazine's "sexiest woman alive."

NY judge dismisses charges against Foxy Brown (AP)

NEW YORK – A judge on Tuesday dropped charges that rapper Foxy Brown violated a court order by mooning her neighbor after the woman told prosecutors she would not testify at the trial.

Assistant District Attorney Robert Isdith said he had tried to meet with the neighbor, Irene Raymond, in the weeks before the trial and didn't get anywhere. When he finally got in touch with her, she said she didn't want to pursue the case, he said.

"While the district attorney's office has no doubt the defendant committed this crime, we have no other choice but to dismiss this case," Isdith said.

Brown, whose real name is Inga Marchand, pleaded not guilty to criminal contempt and her trial was slated to begin Tuesday, following a dressing-down at her last court hearing by State Supreme Court Justice John Walsh when she appeared hours late.

The 31-year-old hip hop star was punctual this time, wearing a short silver silk dress and towering spike heels, and smiled and hugged he attorneys as the courtroom erupted when Walsh dismissed the case.

"I was falsely arrested twice, slandered and defamed," she said outside court, as she gave a thumbs-up and smiled for cameras. She described Raymond as jealous, and someone with a "borderline obsession," "someone who wants to be you or have your life ... that I worked really hard for," she said.

The Brooklyn-based rapper was a teenager when she broke onto the rap scene as a protege of Jay-Z, but her career has foundered in recent years.

Prosecutors said Brown violated the order in July 2010 by screaming at Raymond before bending over, baring her buttocks and showing her underwear while shouting an obscenity.

Had the case gone to trial, her attorney Salvatore Strazzullo said her defense would have been not only did she not moon Raymond, but she wasn't even wearing underwear at the time, so the neighbor was not telling the truth.

Brown was issued the order of protection after pleading guilty in 2008 to menacing Raymond with her cellphone. The two had been in a fight over Brown blasting her car stereo outside their Brooklyn building in the leafy Prospect Heights neighborhood. The restraining order is in effect until 2013, her attorney said.

Strazzullo said they would be filing a civil suit in Brooklyn alleging malicious prosecution.

Brown became one of rap's more popular stars in the 1990s, but in recent years she has stayed in the headlines mainly for her legal problems and hot temper. She also has said she suffered from hearing problems.

Her debut CD, "Ill Na Na," was released in 1996. She released her platinum-selling sophomore album, "Chyna Doll," in 1999. Her third album, "Broken Silence," — released in 2001 — reached gold status.

She rapped in the hip-hop group The Firm, which also featured Nas.

Brown said outside court that she's headed directly to the recording studio now that she's free of the case, and said she's not planning to return to criminal court any time soon.

Domestic violence charge dropped against Lohan dad (AP)

BEVERLY HILLS, Calif. – Prosecutors have dropped a misdemeanor domestic violence charge against Lindsay Lohan's father after his ex-girlfriend failed to show up at trial.

District attorney's spokeswoman Sandi Gibbons said Tuesday the office will no longer pursue the case against Michael Lohan after his ex, Kate Major, could not be located.

The elder Lohan was arrested in March and has pleaded not guilty to misdemeanor domestic violence battery.

A trial was scheduled to begin Tuesday, but Gibbons said it could not proceed without Major's cooperation.

Michael Lohan's attorney, Dana Cole, says he worked out an agreement with Major so she wouldn't testify.

Cole says Major wasn't paid anything, and she declined to cooperate because she did not want a court spectacle.

Obama tees off against top Republican critic (AFP)

WASHINGTON (AFP) – A high-stakes golf match teed off Saturday outside Washington -- not the nearby US Open, but a first-ever round between President Barack Obama and his most powerful Republican critic.

While Obama and House speaker John Boehner are on par in their appreciation for birdies and bogeys, they have been at loggerheads over several wedge issues including taxes, spending cuts, and operations in Libya.

But few sports allow people to settle their differences like golf does.

Long walks or cart rides between shots should foster an intimacy that the White House suggests may be useful, with the two leaders relishing the opportunity to discuss key national issues while on the links.

"This is an opportunity that I think has value beyond the game," White House spokesman Jay Carney told reporters on Friday.

But he admitted that while politics -- specifically a showdown between Obama and Boehner over raising the $14.29 trillion debt ceiling -- would be a subtext to Saturday's Obama Invitational, in-depth talks were unlikely.

"I think I can say with great confidence that they will not wrap up the 18th hole and come out and say that we have a deal," Carney said this week.

But "spending a number of hours together in that kind of environment I think can only help improve the chances of bipartisan cooperation," he said.

"It certainly can't hurt it, unless someone wins really big."

There's a chance of that, if average stroke score is anything to go by.

Boehner is among Capitol Hill's best golfers, with a 7.9 handicap, according to Golf Digest.

Obama, with a 17 handicap, is not in that league, but he has recruited a ringer of sorts -- his playing partner is Vice President Joe Biden (6.3 handicap), who has been handling bipartisan debt ceiling talks.

Obama has another advantage in that they're playing on his home course at Andrews Air Force base.

Boehner recruited Ohio Republican Governor John Kasich, reportedly an eight handicap, to round out the foursome.

While the White House has stressed that the outing is a "social" occasion, Boehner said last week that he was intrigued at the prospect of using his handicap advantage to help whittle down Washington spending.

"Mr. President, you can have all the strokes you want, it'll just cost you a trillion dollars a stroke," he quipped.

Two in court over alleged plot against Joss Stone (Reuters)

LONDON (Reuters) – Two men were remanded in custody in Britain on Thursday in connection with an alleged plot targeting soul singer Joss Stone.

Junior Bradshaw, 30, and Kevin Liverpool, 33, both from Manchester, are charged with conspiracy to rob and commit grievous bodily harm.

They were arrested in the Devon town of Cullompton on Monday, near the home of 24-year-old Stone, whose hits include "Super Duper Love' and "Fell In Love With A Boy', and who is worth an estimated 9 million pounds ($15 million).

Bradshaw and Liverpool spoke only to confirm their identities during the hearing, the Press Association reported.

They will next appear at Exeter Crown Court in western England on July 1.

LOS ANGELES (Reuters) – Actress Lindsay Lohan on Wednesday won a two-year restraining order against a man she says sent her delusional phone text messages and left chocolates at her door.

The order by Los Angeles Superior Court Judge Joseph Biderman came after Lohan had obtained a temporary restraining order against David Cocordan.

Lohan did not attend the court hearing on Wednesday because she was serving a home detention sentence for jewelry theft. She is expected to be released around the end of June.

The 24 year-old star of the films "Mean Girls" and "Freaky Friday" said in court papers last month that Cocordan believed he was in a romantic relationship with her.

Lohan also accused him of contacting her with more than 100 unwanted phone calls and sexually explicit text messages since 2009.

Lohan, who was once considered one of Hollywood's most promising actors, has barely been out of the news for four years due to repeated trips to jail and drug rehabilitation.

Lohan gets court order against sender of texts (AP)

LOS ANGELES – A judge granted Lindsay Lohan a restraining order against a man who left chocolates at her house and sent her bizarre text messages saying they are engaged, court records show.

David Cocordan, 38, has been contacting Lohan for nearly two years and sent her more than 100 texts, including one that describes having sex with the actress, the documents state.

"Given this obsessive and harassing behavior, I am frightened of Mr. Cocordan and feel that my personal safety, and the safety of those around me, is in jeopardy," Lohan said in the legal filing.

Superior Court Judge David Cowan granted the temporary order on Thursday, prohibiting Cocordan from attempting to meet or contact the actress.

The judge will consider whether to issue a three-year stay away order on June 8.

Cocordan, who police believe is a schizophrenic and is not taking medication, has told authorities he does not intend to contest the restraining order, according to court filings.

A phone message left at a listing for Cocordan was not immediately returned Friday.

Lohan's publicist, Steve Honig, said he would not comment on Lohan's security matters.

One text message contained in the court documents indicates Cocordan was in the courtroom last month when the 24-year-old actress was sentenced to 120 days in jail.

The "Mean Girls" star also is performing 480 hours of community service for violating her probation in a 2007 drunken driving case.

The jail time and service were ordered after a judge in April ruled that Lohan should stand trial for taking a $2,500 necklace from a store near her Venice home in January.

Lohan then pleaded no contest to misdemeanor grand theft and has said she hopes to put her court troubles behind her so she can focus on acting.

Video: U.S. Marines Perform Britney Spears' 'Hold It Against Me'

A group of U.S. Marines stationed in Afghanistan seem to be Britney Spears fans and a terrific video of them lip-synching to 'Hold It Against Me' has been making the rounds on YouTube.

The members of 266 Rein and HMLA 169, located "somewhere deep in the heart of Afghanistan," put together the clip, complete with some awesome dance moves, choreography and even some special effects. According to the YouTube post, the video took three months to make due to the group's busy schedule.

The Princess of Pop even saw the video and shared it with her fans. "I am in LOVE with this... I always knew our soldiers were fierce! Thanks for everything you guys do," Britney Spears tweeted Thursday with a link.

I have watched Top Chef since season one but after Angelo, Dale and Marcel all getting the boot while Tiffany remains just baffles the hell out of me ... not sure I will take Top Chef serious anymore just another reality show looking for ratings obviously keeping Tiffany there is just a way to get people to keep watching as they hope for her to finally be told to " pack her knives"

I agree. Tiffany has been on the bottom and could have gone home 5 episodes in a row. She has far less potential than Dale, Fabio, Angelo, or Carla yet she hangs on. I don't understand. If they are searching for the most talented chef, Richard should win. If he doesn't, I digress.

Angelo is a great Chef on this season's show, but others were better. It was/is a tough season with all the chefs being so talented. Tiffany did a really great job in her first season and the night Angelo got the boot she out cooked him. I wish him well and hope to visit his resturant.
