Ruling clears way for start of Jackson trial (AP)

LOS ANGELES – An appeals court refused Wednesday to order the jury sequestered in the trial of Michael Jackson's doctor, Conrad Murray, clearing the way for jury selection to begin Thursday.

The California 2nd District Court of Appeals also declined to delay the trial while the issue is argued. The court found that Superior Court Judge Michael Pastor did not abuse his discretion when he decided not to sequester.

Defense lawyers had argued that jurors would be "poisoned" by publicity unless they were kept in isolation during the trial. The defense predicted that jurors will be inundated with reports in supermarkets, bars, gyms and coffee shops, and on the Internet.

Pastor has said he trusts jurors to obey his orders to ignore publicity in the high-profile involuntary manslaughter case and declined to have them sequestered.

"The court has read and considered the petition," the brief court decision said. "The petition is denied in the absence of a showing of abuse of discretion."

In a separate ruling, Pastor gave the go ahead for a prosecution expert's testimony about a study of the drug that killed the pop star. But he delayed ruling on the admissibility of another study from Chile because it is apparently unpublished.

Defense lawyers say Jackson overdosed by drinking propofol when his doctor wasn't watching. Prosecutors say that was impossible. The drug is normally given intravenously.

The permitted study, which was published in Scandinavia, compares methods of administering propofol to piglets.

The second study by a noted Chilean anesthesiologist used volunteer students who drank propofol. Deputy District Attorney David Walgren said the report supports the opinion of prosecution expert Dr. Steven Shafer that "the rapid hepatic metabolism of propofol makes it impossible for Michael Jackson to have received a fatal overdose by drinking propofol."

He said that Shafer has submitted a written opinion that "there is zero possibility that the propofol was orally ingested."

Walgren quoted from Shafer's opinion that "there is almost nothing in Murray's care of Michael Jackson that reflected the actions of a trained physician."

He said that Shafer, an expert in anesthesiology will say that Murray is responsible for Jackson's death "through extreme and unconscionable violations of the standard of care."

A panel of 160 prospective jurors has been ordered to court for the first round of jury selection. They will be asked if any hardship prevents them from serving. If not, they will be given a 38-page questionnaire to fill out.

Randi Zuckerberg exits Facebook to start own venture (Reuters)

LOS ANGELES (TheWrap.com) – Randi Zuckerberg no longer "likes" Facebook. At least, not enough to remain employed there.

Zuckerberg, the sister of Facebook co-founder Mark Zuckerberg, resigned from the company on Wednesday in order to form her own venture, a spokesperson for Facebook confirmed to TheWrap.

Zuckerberg had served as marketing director for her brother's company.

"We are all grateful for her important service," the Facebook spokesperson said.

In her resignation letter, which was obtained by All Things D, Zuckerberg said she was proud of her work there, but "I know I'll be able to do just as much or more for Facebook once I'm on the outside.

"My goal is to launch my own innovative programing and work with media companies to develop their programing in new, and more social ways," she added.

According to All Things D, her new company will be called RtoZ Media.

Zuckerberg, the author of the book "Spark Your Career in Advertising," served as a panelist on "Forbes on Fox" prior to coming aboard Facebook.

Beyonce album off to strong start despite bad buzz (Reuters)

DETROIT (Billboard) – After reports of dissatisfaction, panic and other pre-release drama, Columbia Records executives say Beyonce's new album "4" is off to a strong start since going on sale worldwide on Monday.

Early indications are that the album will debut at No. 1 in as many as 14 countries, including the United States, Columbia/Epic Label Group Chairman Rob Stringer told Billboard.com.

The first single, "Run the World (Girls)," stalled at No. 29 on the Hit 100 after it was leaked. The album itself was leaked on June 7, three weeks ahead of its June 28 release date. This led to reports that "4" would be delayed and possible altered -- particularly after a tepid response from the blogosphere.

"We didn't want the leaks to happen," Stringer said. "But there was never any discussion of this album moving. It has always been that date. It's been that date for four months now. There was never a conversation about pushing it back, bringing it forward, changing the songs -- none of it."

Stringer said the company is looking at an 18-month campaign for "4," which will include "extensive touring" by Beyonce. Just back from a successful overseas run that included three concerts in France and a closing-night gig at the U.K.'s Glastonbury Festival, she'll roll out a documentary, "Beyonce: Year of 4," on Thursday on MTV and BET, then perform Friday on ABC's GMA Summer Concert Series. She'll head back to the U.K. for a July 9 show at Scotland's T in the Park and a stop the next day at a festival in Ireland.

Amy Winehouse booed at start of tour (AP)

BELGRADE, Serbia – Amy Winehouse has reportedly been booed and jeered at a concert in Serbia's capital that kicked off her European tour.

Serbian media described the performance late Saturday at Belgrade's fortress before some 20,000 fans as a "scandal" and a "disaster."

Media reported the singer was an hour late, before stumbling to the stage and mumbling through her songs. She occasionally disappeared, and her band playing instead.

The crowd responded angrily. Tickets cost about euro40 ($57) — very expensive in the country where average salaries are about euro300 ($428) a month.

Winehouse recently spent a week at a rehab program in London. Her 2006's "Back to Black," won her five Grammy Awards, but her music has been overshadowed by drug use and run-ins with the law.
