US hospital must pay $1M to Garth Brooks

CLAREMORE, Oklahoma (AP) — An Oklahoma hospital in Garth Brooks' hometown must pay $1 million to the country singer because it failed to build a women's health center in honor of his late mother, jurors ruled Tuesday evening.

Jurors ruled that the hospital must return a $500,000 donation to Brooks plus pay him $500,000 in punitive damages in Brooks' breach-of-contract lawsuit against IntegrisCanadian Valley Regional Hospital in Yukon. Brooks said he thought he'd reached a deal in 2005 with the hospital's president, James Moore, but sued after learning the hospital wanted to use the money for other construction projects.

The hospital argued that Brooks gave it unrestricted access to the money and only later asked that it build a women's center and name it after his mother, Colleen Brooks, who died of cancer in 1999.

"Obviously we are disappointed, particularly with the jury's decision to award damages above and beyond the $500,000," Integris spokesman Hardy Watkins said. "We're just glad to see the case come to a resolution."

Brooks called the jurors "heroes" and said he felt vindicated by their verdict.

"I no longer feel like I'm crazy," he said.

Jury member Beverly Lacy said she voted in favor of Brooks because she thought the hospital went back on its word. As far as the punitive damages, she said: "We wanted to show them not to do that anymore to anyone else."

During the trial, Brooks testified that he thought he had a solid agreement with Moore. Brooks said the hospital president initially suggested putting his mother's name on an intensive care unit, and when Brooks said that wouldn't fit her image, Moore suggested a women's center.

"I jumped all over it," Brooks told jurors in tearful testimony. "It's my mom. My mom was pregnant as a teenager. She had a rough start. She wanted to help every kid out there."

His attorney told the jury during closing arguments that Brooks kept his end of the agreement.

"This case is about promises: promises made and promises broken," lawyer John Hickey told jurors shortly before they started deliberating. "Mr. Brooks kept his promise. Integris never intended to keep their promise and never built a new women's center."

But hospital attorney Terry Thomas said Brooks' gift initially came in anonymously and unrestricted in 2005. He also noted that Brooks couldn't remember key details of negotiations with the hospital's president — including what he'd been promised — when questioned during a deposition after filing his lawsuit in 2009.

"At most, it was a misunderstanding between these two," Thomas told jurors during his closing argument. "Am I calling Mr. Brooks a liar? Absolutely not. It's perfectly understandable that he does not remember these events."

The jury began deliberating Tuesday afternoon in Rogers County District Court, and the judge told jurors she wanted them to work as late as midnight to come to a decision.

Before the verdict was read, Brooks said the day had been emotional. The country music star said he was simply trying to honor his mother.

CLAREMORE, Okla. (AP) — An Oklahoma hospital that failed to build a women's health center in honor of Garth Brooks' late mother must pay the country singer $1 million, a jury has ruled.

"This little pistol, she deserves nothing but good," Brooks said.

Etta James on breathing machine in Calif. hospital

LOS ANGELES (Reuters) - Grammy-winning singer Etta James, who has been deemed terminally ill with leukemia, has been hospitalized in California and placed on a breathing machine, her long-time manager and friend said on Friday.

James, 73, best known for the blues ballad "At Last," was taken to the hospital near her home in Riverside, east of Los Angeles, earlier this week because she was struggling to breathe.

"They took her to the hospital. She was having trouble breathing, so they intubated her. She is on a breathing machine and is resting," Lupe De-Leon, the singer's manager for 30 years, told Reuters.

The singer has been in failing health for a number of years and suffers from leukemia, kidney disease and dementia but had previously been cared for at her Southern California home.

Her live-in doctor said last week that James was considered terminally ill, and that she communicates mostly with nods and simple words.

The three-time Grammy Award singer earlier battled obesity and was addicted to heroin for many years.

"It is really sad. She is like my sister," De-Leon said on Friday.

James was a key figure in the early days of R&B music with hit songs like "The Wallflower" and "Good Rockin' Daddy". But it was her 1961 recording of "At Last" that put her on the map.

Singer Loretta Lynn out of hospital (Reuters)

NASHVILLE, Tenn (Reuters) – Country music legend Loretta Lynn was resting at home on Monday after spending part of a "scary" weekend in the hospital suffering from pneumonia, the singer said.

"It was one scary night ... But I am feeling better and just gonna take it easy for a couple of weeks," she said in a statement from her home in Hurricane Mills, Tennessee.

The 76-year-old music icon went to a Kentucky hospital early on Saturday after awakening on her tour bus complaining of difficulty breathing, her web site said.

Lynn canceled her two weekend performances in Kentucky and North Carolina, but the statement said she expected to return to the stage on November 3 in Knoxville, Tennessee.

The singer, who grew up poor in Kentucky's coal-mining country before rising to fame, has additional performances scheduled in Mississippi, Louisiana and North Carolina.

Lynn, whose hits including "If You're Not Gone Too Long" and "Don't Come Home A Drinkin'," has released 70 albums and charted 16 No. 1 hits in a career spanning five decades.

She has won two Grammys and written several books, including "Coal Miner's Daughter," which was made into a movie that earned Sissy Spacek an Oscar for her performance as the singer.

Gavin DeGraw out of hospital, cancels concerts (Reuters)

NEW YORK (Reuters) – Singer Gavin DeGraw was released from a New York hospital on Tuesday after apparently being attacked by three men and hit by a taxi cab, causing a concussion, broken nose and numerous cuts and bruises.

Police said they were investigating an assault by three males in the city's East Village in the early morning hours on Monday, but said it was unclear what led to the attack.

"The victim claims to have been struck by these individuals and taken to hospital," a police spokesman said. Police would not comment on whether DeGraw had been drinking.

The 34-year-old singer also reported having been struck by a taxi soon after the assault. He had just left a group of friends when the attack took place. No arrests have been made and no motive has emerged for the assault.

The New York singer, whose hits include "I Don't Want to Be" and "Chariot," was suffering from "a concussion, broken nose, black eyes, cuts and bruises," his representatives said.

DeGraw has been the opening act for the first leg of rock bands Train and Maroon 5's U.S. tour. His spokeswoman said that due to the injuries, DeGraw will not be performing on August 12 or 13.

"Gavin and his family appreciate everyone's concern at this time," the spokeswoman said in a statement.

DeGraw got his start playing in nightclubs in and around Manhattan and hit it big when "I Don't Want to Be" was chosen as the theme song for television drama, "One Tree Hill.

Joe Paterno released from hospital, planning return to work (Reuters)

PITTSBURGH (Reuters) – Legendary Penn State football coach Joe Paterno was released on Tuesday from a hospital where he was taken to be treated for injuries suffered in an on-field collision with a player over the weekend, the university said.

The 84-year-old Paterno's right arm and hip were injured when he was blindsided by a player during a practice on Sunday, Penn State said in a statement.

Paterno was able to walk away after the incident, but he was taken to Mount Nittany Medical Center for tests, the university said.

He was released from the hospital late on Tuesday morning, Penn State said.

It said no surgery had been needed but provided no further details on his condition.

"It's time for everyone to turn the attention to the team," Paterno said in the statement. "We have a lot of hard work ahead in order to be as good as we think we can be."

The university said Paterno had worked on Tuesday's practice plans and was planning to attend a practice on Wednesday.

With 401 victories, Paterno has won more games than any other coach in college football history. He is scheduled to begin his 46th season as coach of the Nittany Lions on September 3, when the team is slated to play Indiana State.

LA children's hospital gets art by Michael Jackson (AP)

LOS ANGELES – Sketches by Michael Jackson as well as a signed portrait of the entertainer will decorate the walls of Children's Hospital Los Angeles.

Jackson's three children — Prince, Paris and Blanket — were on hand Monday to unveil the donated artwork. They include a dozen sketches drawn and signed by Jackson and a photographed portrait of him.

The works depicting Mickey Mouse, furniture and other objects were donated by Brett Livingstone-Strong, an artist and friend of Jackson's.

Former "Entertainment Tonight" host Mary Hart, a hospital trustee, arranged the donation. She says the sketches show a different side of Jackson.

The singer's sister, La Toya Jackson, says she believes the art will bring joy to children at the hospital.

Ex-NFL quarterback Joey Harrington out of hospital (Reuters)

LOS ANGELES (Reuters) – Former Detroit Lions quarterback Joey Harrington was discharged on Wednesday from a Portland hospital, where he was treated following a bike accident over the weekend.

Harrington, 33, suffered a broken clavicle and rib and punctured lung on Sunday evening when he was struck from behind by a sport utility vehicle while riding through Portland.

He was admitted to Oregon Health and Science University Hospital and was in intensive care before his condition was upgraded to fair.

The former athlete was discharged on Wednesday, hospital spokeswoman Tamara Hargen-Bradley told Reuters.

Harrington was wearing a helmet during the bicycle ride, which his father said likely prevented more serious injury.

Harrington, now a sports broadcaster, was a standout for the Oregon Ducks, leading them to a Fiesta Bowl victory in 2002.

The driver of the SUV, Derek Johnston, 26, cooperated with police and was cited for following too closely.

Singer R. Kelly out of hospital after surgery (AP)

CHICAGO – A spokesman for R. Kelly says the R&B singer is out of the hospital following throat surgery this week.

Spokesman Allan Mayer said Thursday that the 44-year-old left Northwestern Memorial Hospital in Chicago and is recuperating at his home in the city.

Mayer says it isn't clear when the Chicago native might be well enough to resume performing.

The self-proclaimed Pied Piper of R&B released a critically acclaimed retro-soul album last year, titled "Love Letter." He recently completed the U.S. leg of a worldwide tour.

Mel Gibson visits kids at Guatemala hospital (AP)

GUATEMALA CITY – Mel Gibson talked with Guatemalan children born with deformities during a stop at a hospital Wednesday, a visit that was part of a community service sentence for battering his ex-girlfriend.

The Oscar winner's publicist, Alan Nierob, said Gibson has been in the Central American country for several days working with Mending Kids International, a children's charity.

Nierob said Gibson is spending more time working in Guatemala than the 16 hours of community service that a plea deal calls for him to perform.

Gibson pleaded no contest in March to a misdemeanor charge for striking former girlfriend Oksana Grigorieva during a January 2010 fight, but did not admit guilt.

A judge approved his working with the charity, which the actor-director's estranged wife, Robyn Moore Gibson, once led. Mending Kids provides free surgery for children with cleft lips or spina bifida, a disorder in which the spinal canal and backbone don't close prior to birth.

Gibson, who wore a purple T-shirt with Mending Kids logo, said he has been coming to Guatemala the past 15 years to support the charity.

He spoke to reporters on the condition of not answering questions about his personal life. He is currently in a custody battle with Grigorieva.

Poland's democracy icon Walesa in hospital (AFP)

GDANSK, Poland (AFP) – Polish communist-era opposition icon and Nobel laureate Lech Walesa is being treated in hospital for gastric problems and a fever, he told AFP on Thursday.

"I haven't been feeling well since Tuesday. I had a 39-degree fever, gastric trouble and was shivering," Walesa said, adding that he finally decided to go to hospital on Wednesday.

"I'm on a drip. The doctors managed to bring down the fever but haven't yet given a diagnosis and want to keep me in hospital until at least Sunday," the 67-year-old said.

"I hope I'll be back in the saddle next week," he added, noting that he had to cancel planned visits to Italy and Romania.

Shipyard electrician Walesa was leader of Solidarity, a union born during a 1980 strike in the Baltic port of Gdansk that won grudging recognition from Poland's communist regime.

The authorities backtracked in 1981 and imposed martial law to crush Solidarity, but it kept alive underground. Walesa won the Nobel Peace Prize in 1983.

Solidarity returned to the fore in 1989, negotiating an election deal with the regime and scoring a victory helped bring down the entire Iron Curtain by 1991.

In 1990, Walesa became Poland's first democratically-elected president since World War II, serving one five-year term.

He has remained a respected democracy activist, and recently travelled to Tunisia to offer know-how for its transition.

Indian superstar Rajinikanth to leave hospital (AFP)

CHENNAI, India (AFP) – Indian film megastar Rajinikanth is to be discharged from a hospital and flown to Singapore, doctors said Friday, just over a week after he was taken into intensive care.

Doctors at the private Sri Ramachandra hospital in the southern city of Chennai declined to say whether his treatment would continue in Singapore, which has some of the best medical facilities in Asia.

Rajinikanth has had fluid drained from his lungs to ease a breathing complaint and some dialysis for a kidney ailment.

"Singapore is a place to relax and enjoy and if someone is visiting Singapore it is for rest and recuperation," one doctor said.

Rajinikanth, a former Bangalore bus conductor, is one of Indian cinema's biggest stars and inspires a near god-like devotion from his legions of fans.

He was taken ill at the end of April on the first day of shooting for his new film "Rana" (The Monarch) and has been in and out of hospital ever since, sparking a vigil by fans and prayers for his swift recovery.

Tickets for a Singapore Airlines flight have been booked for Rajinikanth's two daughters, one son-in-law, a doctor who treated him in Chennai and his driver, a source at Chennai airport said.

Rajinikanth, who is often referred to in southern Tamil Nadu state simply as "The Superstar", had been booked in as a wheelchair passenger.

Zsa Zsa Gabor back in hospital with pneumonia (AFP)

LOS ANGELES (AFP) – Ailing actress Zsa Zsa Gabor has been admitted to hospital again suffering with pneumonia, in the 94-year-old's latest health scare, her spokesman has said.

Her husband, Prince Frederic von Anhalt, called a doctor after she had difficult breathing, and she was diagnosed with pneumonia, said spokesman John Blanchette.

"He immediately called for an ambulance and right now they're trying to save her life, trying to drain her lungs," he said, declining to say if the scare was more serious than previous occasions when she has been taken to hospital.

Her husband "is hoping that she'll be able to survive. Their 25th wedding anniversary is in August, and he wants to celebrate that," the publicist told AFP.

Gabor, a platinum blonde actress known for her flamboyant lifestyle, legal troubles and multiple marriages, was briefly hospitalized after Elizabeth Taylor died in March, declaring she feared she would be next to go.

Her long career included spots in a dozen films and TV series, such as John Huston's 1952 "Moulin Rouge" and the 1958 film noir "Touch of Evil" by Orson Welles. She also lent her voice to several animated films and TV series.
